Hi everyone. I am pretty new here. I would like your advise if you can help. I collected an item today that appeared to be in good condition when i collected it and the seller of the item helped to load the goods in to the van. The item was secured and iset of for the journey. On reaching the destination when i lifted the item out of the van the item fell apart in two pieces. When i inspected the parts i found that a metal casting has broken and it looks unrepairable. The customer refused to aceppt the delivery (understandable) and wants the cost of the item refunded or repaired professionally with a warrenty. She is holding me responsible. I think that the casting must have been cracked before i collected the item but i cannot prove it. If i am held reponsible i have to either pay out of my own pocket or try and claim on my insurance. ebay item? first mistake! I would contact the seller and arrange to return the goods if they are reasonable then they should refund the buyer and pay you, What goods are they? Did you get any instructions on lifting?

HI, thanks for your response. The item was a siemens rotary iron. They did not give any lifting or handling instructions

In the description ; This is a very heavy and fragile item, so I would prefer to deliver it to you in person, and I disencourage couriers because it is very easy to damage this item.

If that was the case, then why did he/she let a courier deliver it, a bit mad really.

If it wasn't damaged when you collected it and it was damaged when you delivered it then it's your fault. And you need to take resonsibility for it. GiT insurance claim by the sound of it.

I have just been looking at the iron and put it together. The top part of the iron is hinged to the bottom part and is locked into place by means of a pin. If you put it back together the locking pin holds the two parts together although the hing is broken. I have been able to lift the complete iron while it is in this condition and you can push it around on its castors without any problem. In another words it appears to be ok. I beleive it was in this condition when i collected it so i wont have known it was damaged! Looking at where the hige has broken i dont think it looks like a fresh break. If it was broken when i collected it am i still liable...

You may have been scammed by the seller if it is an old break. May need an engineer's report. Or just get a good old fashioned local engineering Co to do a repair. Either way I would suggest that it is your shout and will have to be put down to experience.

The question about who is liable all depends on whether you signed for the goods as unexamined upon collection or just a cleans signature, it all hinges on this, as for a GIT claim, what are the true value of the goods. Try to iron it out with the customer and see if things can be smoothed over that way.

If you are certain that the damage was not caused by you, then just dump it back with the seller and it's his problem from there.
If you aren't sure, then you or your insurance company just bought a broken industrial iron.

The only thing you can do to avoid this in the future is to make sure that from now on you only carry items which are properly packaged or palleted and wrapped.

FFS Just put it down to experience bite the bullet and get it repaired, of course its your fault if you are stupid enough to place an item like that on your van without taking photos (a must for all eBay jobs ) and checking its condition then it is down to you regardless of the condition when you collected it. If as you feel it was on old break then you try and prove it. What was it sold for? I have done a number of these for a polish guy down south and I think he knocks them out on eBay from around £35 to £80 so it can't hav been worth that much. Find out off eBay then offer him half and that way it saves your reputation.

Sometimes you need to know when you are beaten. Pay up put it down to experience ( you won't let it happen again), and move on to next job.
