What do the members think of companies that go bust and then carry on in a different name leaving fellow members out of pocket, dont answer their phones, respond to messages etc

I'm all for making others aware of a situation, but 'naming and shaming' type threads tend to get rather heated and shift the focus of the site away from what we're all about. i.e. don't be surprised if we moderate hot topics.

Admin that's ok if it's a limited company but sole traders are not covered. how about a page to list those that don't pay alowing 1 complaint to include invoice number, amount and any issues with the job and 1 reply to it that way both sides get to put their point without it streaching off into a slanging match. Restrict it to statments of fact and remove any imbelishments

I think they should be named public and for example here on our forum, because if we think about we mite save someone's money... but that is me just saying....

And then there are those who go bust and carry on in the same name - without the LTD. on the end.

I've just had a quick look at the info on the registration page you recommended. I subscribe to Creitsafe they sound similar. The problem I started this post on would not of been helped by either. In this case it was a sole trader, however even if he was a Ltd Co the result would have been the same.
All these sites do is give you a snapshot of their accounts over a twelve month period that ended up to nine months ago. 
My gripe with sites like yours & CX that I've been a member of for several years now is that the standard line is ' we're only a platform for you people to trade on' Not so in my opinion, you have a moral, if not legal, obligation to ensure that whoever posts work on site pays for it, preferably at the time of booking to an I dependant third party, a Paypal or similar, and the person taking the job, to do it professionally & on time. Failure to do so leading to a penalty if the client has not been kept up to speed on any problems. That way everyone would have confidence in the system and that for you would be a unique USP which would give your operation a massive boost. Now instead of telling me 'why not' for a change in the UK can we have a 'hell yes, let's see if it can be done ' sort of attitude.

I would have a moral obligation if I guaranteed that everyone using the site was always going to be 100% straight. I don't, I provide as many facilities as I can to help you make an informed decision. Of course you can also do your own research off the site too.


The suggestion that I have a legal obligation is laughable. Do you think autotrader has an obligation to go after a dodgy car trader? I'd imagine the most they might do is prevent them from using their site.

Policing every transaction that goes through mtvan would be a full time job - not something you or anyone else on this site would even contemplate covering the cost of.

You also misread my words, when I said you had a moral IF not legal responsibility. I know you don’t have a legal responsibility, that was not what I said or meant, and alas you appear to have shown your true colours. If I ran a pub and allowed everyone to come in and get drunk, I would have a responsibility for their behaviour on 'my premises', and I see no difference when you or cx or anyone else who runs these sort of sites. You do have a responsibility and as I suggested previously if you had the cojones and implemented a pay up front, with protection, system then it would be a win, win, win situation, but no you have to mock me, very professional, not

Also, not wanting to get into a debate about the English language, but 'you have a moral, if not legal, obligation' means to me 'you definitely have a moral, and possibly a legal obligation'. So to me you did appear to be suggesting that I might have a legal obligation.

Anyway, I am interested in hearing out your thoughts and ideas. If we were to implement a pay up front system (escrow type thing I guess) do you not think this would lead to a costly dispute resolution process? Also if vendors had to pay up front, would they be willing to post work any more or would they just move to the next site down the food chain? Would be good to get the opinions of some of the vendors on here.
